Overview
This Acceptable Use Policy ("AUP") applies to all merchants and partners using the OnAnthem platform. It defines the standards of conduct and content requirements that all users must follow. Violations may result in listing removal, account suspension, or permanent termination.
This policy supplements our Terms of Service. In the event of a conflict, these terms control with respect to acceptable use.
Prohibited Products
The following products may not be listed or sold through the OnAnthem platform. This list is not exhaustive, and OnAnthem reserves the right to remove any product at its sole discretion.
Illegal and Regulated Items
- • Products that are illegal to sell under applicable federal, state, or local law
- • Controlled substances, illegal drugs, and drug paraphernalia
- • Firearms, ammunition, explosives, and weapons
- • Tobacco products, e-cigarettes, and vaping devices
- • Alcoholic beverages (unless specifically authorized with proper licensing)
- • Products subject to regulatory approval sold without required certifications (e.g., FDA-regulated items)
Harmful and Unsafe Items
- • Recalled products or products known to be unsafe
- • Hazardous materials without proper handling and shipping compliance
- • Products designed to facilitate illegal activity
Fraudulent and Infringing Items
- • Counterfeit or replica products
- • Products that infringe on intellectual property rights (trademarks, copyrights, patents)
- • Products with misleading claims or false certifications
- • Stolen goods or goods obtained through illegal means
Other Prohibited Items
- • Adult or sexually explicit content
- • Products promoting hate, violence, or discrimination
- • Human remains, body parts, or bodily fluids
- • Live animals
- • Personal information or data of third parties
Prohibited Conduct
Merchants and partners may not engage in the following conduct on the platform:
Fraud and Deception
Manipulating pricing, inventory, reviews, or any platform feature to deceive buyers or gain unfair advantage
Platform Manipulation
Circumventing fees, commission structures, or platform mechanisms through deceptive means
Harassment and Abuse
Harassing, threatening, or abusing other users, buyers, or OnAnthem staff
Misrepresentation
Operating under a false identity, impersonating another business, or misrepresenting your affiliation
- • Creating multiple accounts to circumvent enforcement actions
- • Using the platform to collect personal information for purposes unrelated to order fulfillment
- • Interfering with the proper functioning of the platform or other users' accounts
- • Scraping, crawling, or using automated tools to extract data from the platform without authorization
- • Redirecting buyers off-platform to avoid OnAnthem fees or processing
Listing Requirements
All product listings on the OnAnthem platform must meet the following standards:
Accuracy
- • Product titles and descriptions must accurately represent the item being sold
- • Images must depict the actual product the buyer will receive
- • Pricing must reflect the true cost of the item, excluding applicable taxes and shipping
- • Inventory levels must be kept current to avoid overselling
Compliance
- • Listings must comply with all applicable advertising and consumer protection laws
- • Required disclosures (e.g., allergen warnings, material composition) must be included where applicable
- • Non-returnable items must be clearly marked as such before purchase
Quality Standards
- • Products must be shipped in the condition described in the listing
- • Merchants must maintain reasonable fulfillment timelines
- • Merchants must respond to buyer inquiries in a timely manner
Partner Conduct
Partners who distribute merchant products through their storefronts must adhere to the following standards:
- • Accurately represent merchant products without altering descriptions in misleading ways
- • Disclose the relationship between the partner storefront and the merchant fulfilling the order
- • Not make claims about products that are not supported by the merchant's listing
- • Comply with all applicable advertising, endorsement, and disclosure laws (including FTC guidelines)
- • Protect buyer data collected through the checkout experience in accordance with our Privacy Policy
Reporting Violations
If you believe a merchant, partner, or listing violates this policy, please report it to us. Include as much detail as possible, such as the product listing URL, the nature of the violation, and any supporting evidence.
Reports can be submitted to legal@onanthem.com. All reports are reviewed and kept confidential to the extent permitted by law.
Enforcement
OnAnthem reserves the right to take action against any user who violates this policy. Enforcement actions are determined at our sole discretion and may include:
Warning
A notification of the violation with a request to correct the issue
Listing Removal
Removal of specific product listings that violate this policy
Account Suspension
Temporary suspension of account access and selling privileges
Account Termination
Permanent removal from the platform for severe or repeated violations
Severe violations (such as selling illegal products or engaging in fraud) may result in immediate account termination without prior warning. OnAnthem may also report violations to law enforcement where required or appropriate.
Appeals
If you believe an enforcement action was taken in error, you may submit an appeal to legal@onanthem.com within 30 days of the action. Include your account information, a description of the enforcement action, and the reason you believe it was incorrect. Appeals are reviewed within 14 business days.
Changes to This Policy
We may update this Acceptable Use Policy from time to time. Changes will be posted on this page with an updated effective date. Material changes will be communicated via email or through the platform. Continued use of the Service after changes are posted constitutes acceptance of the updated policy.
